Sorry jako... aneb jak reklamovat boty u Deichmanna

Když letos v listopadu začínalo přituhovat, musela jsem se vzdát svých lodiček a vylovit své zimní boty, takové kozačky z Deichmanna. Koupila jsem si je před rokem, 24. 11. 2015, a brzy jsem zjistila, že se mi rozpadají – po jedné zimní sezóně a asi 10 měsících ležení v krabici, abych to upřesnila. V tu chvíli jsem začala hledat účtenku, protože jsem měla tušení, že boty mám opravdu jen jeden rok a mohla bych je tedy reklamovat. Po nějaké době jsem účtenku skutečně objevila a jala jsem se boty reklamovat. Reklamovala jsem je proto, že se podrážka začala odlepovat, zejména kolem pat z vnitřních stran chodidel. Nechtěla jsem čekat na okamžik, kdy se podrážka zcela odlepí (což se mi už u jedněch Deichmann bot stalo, prostě jednou zapršelo a já domů přišla s obrovským krokodýlem na špičce boty... tedy ona byla odlepená vlastně celá přední polovina boty... ale těmhle botám už akorát prošla záruka, takže putovaly do popelnice – ať žije fast fashion!) a bude nespravitelná. Žádala jsem o opravu nebo vrácení peněz.
At first I thought I will write this post only in Czech but then I realized why not to tell others also in English (which is more international language) how it works when you want to claim warranty on shoes from Deichmann in the Czech Republic. Let the rant begin...
When it started to be cold once again in November I had to give up wearing my stiletos and pull out the winter shoes, hight boots from Deichmann. I bought them a year ago, on 24th November 2015, but I soon realized that they are falling apart – after just one winter season and about 10 months of resting in a shoe box. In that moment I started  to look for the receipt because I had a feeling I had these boots just for one year and I would be able to make a warranty claim (the period for this claim is 2 years in the CR). I claimed warranty because the sole started to unglue around my heels, especially around the inner part. I did not want to wait for the moment when the sole falls away entirely (which actually happened to me once, once again with Deichmann shoes, it strated to rain and the front half of the sole totally unglued but those shoes were not under the warranty anymore so I threw them away – long live the fast fashion!). I asked for the boots to be repaired or money return.


 
Má žádost o reklamaci ale byla prodavačkou zamítnuta na místě, čímž byla má žádost vyřízena. V jiných obchodech bývá praxí boty zaslat na posouzení ke znalci a proti posudku se lze dvakrát odvolat, ale to evidentně není případ obchodu Deichmann. Když jsem prodavačce oponovala, že s jejím závěrem nesouhlasím, doporučila mi obrátit se na ČOI.
My request was declined by the shop assistant, which meant my request was  handled. In other shops with shoes it works in the following way – you file a warranty claim, they send the shoes to an expert who evaluates the shoes and the request. You can appeal against the expert opinion twice but this is apparently not the case of Deichmann (in the CR). When I said to the shop assistant that I do not agree she recommended that I should appeal to the Czech Trade Inspection Authority (http://www.coi.cz/en/).

Prodavačka jako důvod pro zamítnutí reklamace uvedla, že jsem si poškození bot způsobila (jak jinak) sama špatným zouváním bot a že jsem je měla přijít reklamovat dříve (ano, také oblíbené zaklínadlo) a žádat opravu.
The reason why the shop assistant declined my request was that I apparently caused damage to the boots myself (how surprising) in the way I am taking the boots off and that I should have come earlier to claim the warranty (another very favourite magic formula) and request reparation.

    1) Toto tvrzení si protiřečí, protože pokud jsem si poškození bot způsobila sama, pak nemohu prodejce žádat o opravu bot - s tímto mi i byla reklamace zamítnuta - žádala jsem opravu nebo vrácení peněz. Paní řekla, že oprava není možná, protože jsem boty sama rozbila... vidíte taky ten bludný kruh nesmyslů?
    1) This statement contradicts itself because if I caused the damage to the shoes then I cannot claim warranty and request reparation – especially because this is the reason why my claim was denied – I requested reparation or money. The shop assistant said the reparation is not possible because OI caused the damage to the shoes... do you see this vicious circle of nonsense too?

    2) Toto tvrzení je nepravdivé. Pochybuji o tom, že paní prodavačka někdy byla přítomna u toho, když si zouvám boty, takže nevím, jak může tvrdit, že jsem si poškození bot způsobila sama právě nevhodným způsobem zouvání bot a na základě toho posoudit, že na reklamaci nemám nárok. Boty si navíc nezouvám tím prasáckým způsobem, kdy se ta druhá bota přišlápne. Upřímně to by snad u kozaček ani nemohlo fungovat, ne? Ale možná se mýlím a paní prodavačka si takto boty sundavá každý den, když přijde z práce (snad se jí nerozpadnou...). A pokud si myslela, že mám profesionálního sundavače bot, který při sundavání mých kozaček tahá za podrážku, pak bych asi neměla potřebu kupovat si boty v Deichmannovi.
    2) This statement is untrue. I doubt the shop assistant ever saw me taking my shoes off so I don´t know how she can claim that this is the way I do it and based on this assumption of hers decline my warranty claim. Especially when I do not take my shoes off in the heinous way when you step on the heel of the shoe to take it off. To be honest I even doubt something like this would work with high boots. But maybe I am wrong and the shop assistant is taking her shoes off like this every day when she comes from the work (hopefully hers will not fall apart...). And if the shop assistant though that I am employing a person who would take my shoes off and that person damaged the shoel by pulling the soles then I would probably not be buying my shoes at Deichmann.

No dobře no, na reklamační protokol jsem napsala velké NESOUHLASÍM a dostala jsem poučení o mimosoudním řízení s asistencí ČOIky. Toto je evidentně pokus Deichmanna zbavit se nespokojených zákazníků, kteří se pokoušejí o reklamaci, protože věřím, že mnoha z nich se to už nechce dál řešit. Podobně funguje u mnohých obchodů i to zasílání bot kamsi na posouzení, málokdy se vám stane, že na poprvé by to hned uznali – vždy je to vaše chyba, nesprávné používaní a tak podobně. Budete-li si však stát za svým a otočíte to, vaše šance na úspěch se zvyšuje. Prokazujete tím totiž, že si za svým názorem stojíte a opravdu chcete zboží reklamovat (na mě to takhle zkoušeli v jiném obchodě – nejdřív tvrdili, že se boty rozpadly, protože jsem je nepřinesla reklamovat dřív, jako WTF?, napodruhé už mi peníze vrátili).
Well ok then I wrote huge I DON´T AGREE on the warranty claim record and got a paper that informed me I can proceed with my complaint to the Czech Trade Inspection Authority. This is evidently Deichmann trying to get rid off customers who want to claim warranty because I believe many of the won´t proceed. This is happening in onter shops too but it works differently – they are sending the shoes to an expert who evaluates it and usually in the first round thecustomer´s claim is declined – the customer caused the damage etc. If you return it that you do not agree the chance you are getting your money back is getting higher because you are persistent. (This actually happened to me too in another shop, they said I should have come to claim the warranty earlier, WTF?, in the second round they returned me my money.)

Paní prodavačka mi doporučila ČOIku, tak když si to žádá... a ejhle, zde je ten kámen úrazu, kde se vás Deichmann a jeho „profesionálně zaškolené prodavačky“ elegantně zbaví – bohužel, co jsem si tak četla na internetu to vypadá, že na podání podnětu ČOIce bych potřebovala posudek dalšího znalce a za to fakt peníze vyhazovat nebudu. To radši dám vydělat ševcovi, pokud uzná za vhodné ty křusky vůbec opravovat (někdy je lepší si nechat poradit někým, kdo se v tom – opravdu – vyzná, nejednou jsem byla svědkem toho, kdy někomu doporučil boty vyhodit, protože se oprava takového shitu ani nevyplatí). Deichmann sice ve svém reklamačním řádu tvrdí, že všechny investice zákazníka do případného sporu nahradí, ale nedivila bych se, kdyby se ještě diskutovalo o tom, jestli ty náklady byly vlastně oprávněné a jsou v přiměřené výši. Mě totiž na tyhle žabomyší války neužije – a na to se vlastně takové firmy spoléhají, že to zákazník přestane řešit, protože by tím akorát ztrácel čas a peníze.
The lady recommended me to proceed to the Czech Trade Inspection Authority... aaaha and here is the moment when Deichmann and their „professionally trained shop assistants“ get rid of you – unfortunatelly (after some googling) it looks like the customer has to obtain another evaluation from an expert to be able to proceed with the complaint at the Czech Trade Inspection Authority and I am unwilling to put more money into this. I would rather give this money to a cobbler if he thinks it is worth to even make a reparation of such boots (it happened not only once that I had seen the cobbler that it is not worth to invest in s reparation of such shit). Deichmann claims in their code that they will pay the customer what s/he had to invest in the claim but I would not be surprised if there would be another discussion about it - if the investment was eligible and adequate. And you know what? I am not into such trifling disputes, it is not my hobby – and this is actually what these firms are relying on, that the customer will stop making the claim because it takes time and money.

Takže ano, Deichmann vyhrál, nemusí mi opravovat boty nebo mi vracet peníze. Ztratil však zákazníka a ke všemu takového, který to rozmazává někde na internetu, protože jak je všeobecně známo – o pozitivním či neutrálním zážitku se zas tak nemluví, ale o ten negativní se rádi podělíme s kým to jde ;). Tenhle blog sice není nijak super-čtený a známý, ale i tak. Mě stačilo si trochu zagooglit a podobných zážitků jsem si na internetových diskusích a blozích přečetla desítky, takže ono na tom něco pravdy bude.
So yes, Deichmann wins, they do not have to repair my boots or give me my money back. But they lost a customer, a customer that will write about the experiance online because it is a truth universally acnowledged that the positive or neutral experience go usually unnoticed but the negative one will be shared as much as possible ;). This blog might not be followed and read much but still. I tried to google a little and there are tons of similar stories in online discussions or on blogs so there might be some truth in it.

  1. Totéž se mi stalo s počítačem, dala jsem za něj jako studentka všechny peníze, po několika měsících křupnul pant a při každé ze tří reklamací jsem se dozvěděla, že je to moje vina.

    1. Ou tak to mě mrzí, noťas je přecijen jiná cenová liga než křusky za litr :/. Doufám, že zahlásili něco ve stylu "ale vy jste jej používala!"
